What Are Cookies?
Cookies are small text files placed on your device (computer, phone, or tablet) by websites you visit. They are widely used to make websites work efficiently, remember your preferences, and provide information to the website owner.
Beyond classic cookies, we may also use local storage, session storage, and pixel tags (also called web beacons) — these serve similar purposes and are covered by this policy.
Why We Use Cookies
We use cookies to:
- Keep you signed in as you navigate between pages of the Platform
- Remember your search filters, location preferences, and recently viewed listings
- Protect your account and our Platform from security threats like CSRF attacks
- Understand which features are most used so we can improve them
- Measure the performance of our pages and identify errors
- Show you relevant promotional content (only with your consent)
- Attribute traffic to the correct marketing channels for budget planning
Types of Cookies We Use
We organise our cookies into four categories. Expand each category to see the full list of cookies, their purpose, and how long they remain active.
Toggle categories above, then save your preferences.
Third-Party Cookies
Some cookies on our Platform are set by third-party services we integrate with. These are governed by their own privacy policies, which we encourage you to review:
Your Choices & Control
5.1 Cookie Consent Banner
When you first visit Embakasi33, we present a cookie consent banner. You can accept all cookies, reject non-essential ones, or customise your preferences by category. You can revisit and change your preferences at any time using the toggles in Section 3 above or via the cookie icon in our site footer.
5.2 Browser Settings
All major browsers allow you to manage cookies through their settings. Instructions for the most common browsers:
5.3 Opt-Out Tools
You can opt out of specific third-party tracking tools directly:
- Google Analytics: Install the Google Analytics Opt-out Browser Add-on
- Meta advertising: Manage preferences via Facebook Ad Preferences or optout.aboutads.info
- Interest-based advertising: Visit the Your Online Choices portal
- All tracking: Use a browser extension such as uBlock Origin or Privacy Badger
Do Not Track
Some browsers offer a "Do Not Track" (DNT) signal that you can enable to request that websites do not track your browsing activity. There is currently no agreed industry standard for how websites should respond to DNT signals.
At present, Embakasi33 does not alter its data collection practices in response to DNT signals. We encourage you to use our cookie preference centre (Section 3) or browser settings to exercise meaningful control over tracking, as these mechanisms are more reliable.
We continue to monitor developments in this area and will update this policy if the industry adopts a standardised approach.
Legal Basis Under Kenyan Law
The use of cookies that involve the processing of personal data is governed by the Kenya Data Protection Act, 2019 (DPA), the Kenya Information and Communications Act, Cap 411A, and regulations issued by the Communications Authority of Kenya.
- Strictly necessary cookies are processed on the legal basis of contractual necessity — they are required to deliver the service you have requested
- Functional and analytics cookies are processed on the basis of legitimate interests, balanced against your rights, and subject to your right to object
- Marketing cookies are processed only on the basis of explicit consent obtained through our cookie banner, which you may withdraw at any time
Where cookies are set by third-party providers, those providers act as independent data controllers for the data collected through their own cookies and are responsible for their own legal basis for processing.
Cookie Retention Periods
Each cookie has a defined retention period, listed in the tables in Section 3. As a general principle:
- Session cookies are deleted when you close your browser or end your session
- Authentication cookies expire after 30 days of inactivity; you will be prompted to log in again
- Preference cookies are stored for up to 12 months and renewed if you actively use the Platform
- Analytics cookies follow the third-party provider's retention schedule, typically 12–24 months
- Marketing cookies expire in line with each advertising platform's policy, typically 3 months
You can delete cookies at any time via your browser settings. Deleting strictly necessary cookies will require you to re-authenticate and will reset your preference settings.
Updates to This Policy
We review and update this Cookie Policy whenever we introduce new cookies, retire existing ones, or when our legal obligations change. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Re-show the cookie consent banner where new consent is required
- Notify registered users by email at least 14 days in advance of significant changes
We recommend revisiting this page periodically. Previous versions of this policy are available on request by emailing privacy@embakasi33.co.ke.
